In the historical milestone, Chile has finalized the new draft of the democratically written constitution replacing the neoliberal. The new constitution will enshrine the wide range of human rights. Chile will have a “social and democratic state based on the rule of law”. This will also include “pluractional, intercultural and ecological” characters.

Here is the contents of new constitutional text, regarding all the human rights. It will also include and recognize Chile’s indigenous people and offer restitution for indigenous lands. The constitution which guarantees all the rights contains the following texts-

On Health

The text approves that, “everyone has the right to health and integral wellbeing, including its physical and mental dimensions”. It further states that :”state shall: provide the necessary conditions to reach the highest possible level. Strength and development of public and private institutions. Generate mental health policies and programmes, increasing their funds.”

On Education

It has been agreed regrading education is that: “the primary and obligatory duty of the state is to ensure the right to education for all people. Education must be provided under the principles of cooperation, non-discrimination, inclusion, justice, participation, solidarity , interculturalism, gender focus and pluralism”. Through this it is clear that it seeks for ‘equality’. And it further states that the national education system “must be secular and free of charge”.

On Housing

The proposal is made regarding housing is that, ” everyone has the right to decent and adequate housing. The state shall ensure this right and may participate in the design, construction, rehabilitation, conservation and innovation of housing, with particular consideration for low -income or vulnerable groups”.

On Labor Rights

The state guarantees a decent “work and its protection, fair working conditions, health and its protection, fair working conditions, health, safety, rest and leisure, including trade union organizations.” In addition, the new constitution “prohibits all form of precarious work, forced, humiliating or degrading work”. Furthermore, domestic and care work is recognized as “socially necessary and indispensable for the development of society”.

This new constitution shows that this is a solid, real and unequivocal basis of the constitution. And moving towards a different country altogether, with new rules and which, above all, guarantees equal rights to all citizens. The new text establishes rights for minorities, defines sovereignty, parity-based democracy that will be exercised in a direct and participatory manner.
